The Netherlands Continues to Pioneer Cannabis Policy While Keeping It Illegal

The Netherlands is widely recognized as a global pioneer in cannabis policy. Cannabis remains fully illegal under Dutch law.

The coffeeshop system has operated for decades under a tolerance policy that permits retail sales in tightly controlled circumstances. The supply of cannabis to these same coffeeshops is entirely criminalized. This arrangement is known professionally as the “back-door problem.”

In 2021, the Dutch government launched the Closed Coffeeshop Chain Experiment, designed to test a fully regulated cannabis supply chain. The experiment seeks to solve the problem created by the system it is testing.

Medical cannabis operates under a separate framework. The Office of Medical Cannabis maintains a centralized monopoly on production and distribution, with strict quality controls. Patient access issues and mounting legal pressure now suggest the monopoly structure may require reform.

New products such as concentrates, oils and edibles continue to be classified under the Opium Act. Each classification matters in practice. The regulatory system remains complex.

This is currently being addressed through guidance.
